Chain of custody is the documented trail that tracks a specimen from the moment it is collected to the moment a result is reported. It is the evidentiary backbone of every drug and alcohol test. Common Chain of Custody Errors

1. Missing or Incomplete Signatures

Every transfer of a specimen — from donor to collector, from collector to transport, from transport to laboratory — must be documented with a signature, printed name, and timestamp. Missing signatures are the single most common chain of custody error.

This error often occurs at handover points: the collector seals the specimen correctly but fails to obtain the donor’s signature confirming the seal, or the transport courier signs for receipt but the collector does not sign for release. The chain of custody must account for every moment from collection to laboratory receipt. Time gaps — periods where the specimen’s location and custodian are not documented — create the inference that the specimen could have been tampered with during the undocumented interval.

Time inconsistencies are equally problematic. If the collection time recorded on the chain of custody form does not match the time on the collector’s log, or if the laboratory receipt time precedes the despatch time, the entire record’s credibility is compromised.

Each specimen must be uniquely identified with a specimen identification number that matches across all documentation — the chain of custody form, the specimen container label, and the laboratory requisition. Transposition errors (writing 45678 instead of 45687), illegible handwriting, or failure to record the identifier at all can break the link between the specimen and the donor.

4. Failure to Seal Specimens Correctly

Between collection and despatch to the laboratory, specimens must be stored securely with conditions documented. If specimens are left unattended, stored in an unsecured location, or held for an extended period without documentation of storage conditions, the integrity of the specimen is called into question.

6. Transport Documentation Failures

The handover from collector to transport provider, and from transport provider to laboratory, must each be documented. In practice, specimens are sometimes placed in a courier bag and collected without a documented handover — the collector does not record when the courier collected the specimen, and the courier does not record what was collected.

How Errors Compromise Results

A chain of custody error does not necessarily mean that the test result is wrong. The analytical result may be perfectly accurate. But accuracy is not the issue — admissibility and enforceability are.

  • Fair Work Commission — in unfair dismissal proceedings, the respondent employer must demonstrate that the testing process was fair and procedurally sound. Chain of custody errors provide grounds for the applicant to argue that the process was flawed, even if the result was accurate.
  • Disciplinary proceedings — an employer relying on a positive test result to take disciplinary action must be confident that the result will withstand scrutiny. A broken chain of custody introduces doubt that can undermine the employer’s position.
  • Insurance claims — workers’ compensation claims may be affected by drug testing results, but only if those results are procedurally sound. Insurers and their legal advisors will scrutinise chain of custody documentation.

Best Practices for Error Prevention

Standardised Forms and Workflows

Use a standardised chain of custody form that prompts the collector to complete every required field in sequence. The form should make it physically difficult to skip a step — each section must be completed before the next becomes relevant.

Training and Competency Assessment

Every person involved in specimen collection and handling must be trained specifically in chain of custody procedures. This training should include practical exercises, not merely theoretical instruction. Competency should be assessed and documented, with refresher training at defined intervals.

Real-Time Data Capture

Where possible, replace handwritten documentation with digital capture at the point of collection. Digital systems can enforce mandatory fields, validate data in real time, apply automatic timestamps, and generate unique specimen identifiers without the risk of transcription error.

Witnessed Sealing
